COMPENSATION FOR THE RAPE VICTIM 22/12/2011

A physically challenged girl was being raped by an employee of VSS Medical College and Hospital, Burla, Sambalpur on August 20, 2009.
A FIR had been lodged in the Burla PS on August 21st by her mother. The accused Jayasingh Behera got arrested .
The locals of Burla agitated to take stringent action against the rapist/accused demanding a Bandh. A social activist and an advocate Mr Prabir Das had headed the Human Right Commission asking for compensation of the victim girl.
The case was finally heard by the Chief Judicial Magistrate and Additional District Judge of Sambalpur.
“The district magistrate of Sambalpur had also got a magistrate to conduct an inquiry into the matter. The magistrate had said that the victim was a Dalit girl but the case was not brought under the purview of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act because the girl had not been assaulted because she was Dalit. However, looking at the financial condition of the victim, the magistrate had recommended compensation of Rs 50, 000,” said Adv PrabirDas.
The commission has directed the government of Odisha to pay Rs 3 lakh as compensation to the victim. The commission has also asked the government of Odisha to furnish proof of payment of compensation within six weeks.
